Kibera Court Suspends Fake Madaraka Express Ticket Fraud Case, Orders Age Assessment for Suspected Minor
NAIROBI, July 14, 2026 Proceedings in a fake Madaraka Express ticket fraud case at the Kibera Law Courts have been temporarily halted after one of the suspects informed the court that he was aged 17, prompting the court to order an immediate age assessment before the matter proceeds.
The case, being handled before Court 1 at the Kibera Law Courts, took a new turn when the second respondent told the court that he was below the age of 18 years.
Presiding over the matter, Chief Magistrate Hon. S. Atambo noted that among all the suspects presented before the court, the second respondent was the only one claiming to be a minor.
The court heard that the investigating officer was unable to independently confirm the suspect’s age, explaining that he had not had sufficient interaction with the respondents to establish their personal details.
In ensuring compliance with child protection laws, the magistrate directed that the suspect undergo an age assessment immediately, with a report to be filed before the court to guide further proceedings.
The court also directed that the suspect’s parents or guardians provide any official documentation confirming his age, including a birth certificate or other relevant records, to assist in determining his legal status.
Hon. Atambo emphasized that should the assessment confirm that the respondent is below 18 years, he would be treated as a child under Kenyan law and would be entitled to special protections, including child-friendly judicial procedures and representation by a state-funded advocate.
Pending the outcome of the assessment, the court ordered that all the respondents remain in custody at Modaiga Police Station.
The matter will come up for mention on July 16, 2026, when the court is expected to issue further directions based on the findings of the age assessment.
Addressing the parties in both English and Kiswahili, the court reiterated that the proceedings could not continue until the respondent’s age had been conclusively established to guarantee that all applicable legal safeguards are upheld.
